Airbags
A new bill introduced by Missouri State Senator Jon Dolan aimed at improving the safety of replaced airbags has raised a few concerns among repairers.
The well-meaning bill requires any replacement airbag to comply with all applicable federal safety regulations. However, the bill places the responsibility of ensuring that compliance on the repairer who installs the airbag. Without mention of the manufacturer, or supplier of the replacement airbag, any repairer who would install a non-compliant airbag would be guilty of a class D felony.
The bill also covers used, but undeployed, air bags. The language in this case states that repairers who install an airbag that has previously been installed in another vehicle, must disclose that fact in writing to the vehicle owner. Failure to make the disclosure would also result in the repairer being found guilty of a class D felony.
The Senate Transportation Committee, of which Senator Dolan is Second Chair, held a hearing on this bill on February 1.
This bill is expected to pass out of the Senate Transportation Committee into the House Transportation Committee.
Full text of Missouri Senate Bill 30
AN ACT
To amend chapter 307, RSMo, by adding thereto one new section relating to the installation of motor vehicle airbags, with penalty provisions.

Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapter 307, RSMo, is amended by adding thereto one new section, to be known as section 307.156, to read as follows:
307.156. Any person, firm, or corporation that owns or operates a business engaged in whole or in part in servicing motor vehicles and installs or purports to install an airbag in a motor vehicle and either:
(1) Installs an airbag that does not meet all applicable federal safety regulations for an airbag installed in a vehicle of that make, model, and year; or
(2) Installs an airbag that previously has been installed in another motor vehicle without disclosing in writing to the owner or lessee of the vehicle receiving such airbag installation that a used airbag has been installed in it, shall be guilty of a class D felony.
