Young Drivers

West Virginia has a graduated licensing law.

• Level 1 Instruction Permit: In order to obtain a level 1 instruction permit, a person must be at least 15 years old, have the consent of a parent or guardian, and must pass a written test. People with a level 1 instruction permit cannot drive unsupervised, cannot carry more than 2 passengers in addition to the supervising driver other than family members, and cannot drive between 11 p.m. and 5 a.m.
• Level 2 Intermediate License: May be obtained after reaching the age of 16, holding a level 1 permit for at least 6 months with 30 hours of supervised driving experience or completion of driver’s education, and passing a driving test.
• Passenger Restrictions: Drivers with Level 2 Intermediate Licenses must not carry more than 3 passengers at a time younger than 19 other than family members.
– Nighttime Driving Restrictions: Drivers with Level 2 Intermediate Licenses must not drive unsupervised between 11 p.m. and 5 a.m.
• Full licensure: Driving restrictions end at the age of 18 or after 1 year of holding a Level 2 Intermediate License, whichever comes first. Crashes or violations may delay the process.
